Overtime & Misclassification

Many employees are told they are “exempt” from overtime simply because they are salaried or given a managerial title.

That is not how the law works.

Under the Fair Labor Standards Act (FLSA) and Massachusetts law, exemption depends on job duties, not labels. Misclassification can result in years of unpaid overtime liability.

We represent employees who:

  • Worked more than 40 hours without overtime pay

  • Performed primarily non-managerial duties despite “supervisor” titles

  • Worked off-the-clock

  • Were classified as independent contractors despite functioning as employees

Companies frequently misclassify to reduce labor costs. When they do, the law has your side.
